To the fullest extent permitted by applicable law Holiday Waale and its parent entity Imperial Milestone Private Limited shall not be liable for any direct indirect incidental consequential or special damages including loss of profits loss of business loss of opportunity or personal inconvenience arising out of or in connection with the use of our services.
In all circumstances the total liability of Holiday Waale shall be strictly limited to the amount actually paid by the client for the specific service in dispute.
The client agrees to indemnify defend and hold harmless Holiday Waale its directors employees affiliates and partners from and against any claims liabilities damages losses or expenses including legal fees arising out of
breach of these Terms and Conditions violation of any applicable laws or regulations misuse of services or fraudulent activity incorrect or incomplete information provided by the client
Holiday Waale acts solely as an intermediary for travel services. We shall not be held responsible for any acts omissions errors delays deficiencies or failures of airlines hotels transport providers visa authorities or any third party vendors.
Any disputes related to third party services must be resolved directly with the respective service provider.
Holiday Waale shall not be liable for any failure delay or disruption caused by events beyond reasonable control including but not limited to natural disasters pandemics government restrictions war civil unrest strikes weather conditions or technical failures.
No refunds or compensation shall be guaranteed in such circumstances unless provided by the respective supplier.
All disputes claims or controversies arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Rajasthan India.
Prior to initiating legal proceedings the parties agree to attempt resolution through mutual discussion within 30 days of dispute notification.
If unresolved the dispute shall be referred to arbitration under the provisions of the Arbitration and Conciliation Act 1996 with a sole arbitrator appointed by Holiday Waale. The arbitration proceedings shall be conducted in Rajasthan India and the decision shall be final and binding.
Clients agree not to initiate chargebacks or payment disputes with banks or payment gateways without first contacting Holiday Waale for resolution.
In case of unjustified chargebacks Holiday Waale reserves the right to
recover the disputed amount along with penalties and legal costs suspend or blacklist the client from future services initiate legal action for recovery
By availing services the client expressly waives any claims against Holiday Waale for delays cancellations changes or service deficiencies caused by third party providers or external circumstances beyond our control.
These Terms and Conditions constitute a legally binding agreement between the client and Holiday Waale. Continued use of services implies full acceptance of all policies including cancellation refund and liability clauses.
If any provision of these Terms is found to be invalid or unenforceable the remaining provisions shall continue to remain in full force and effect.
These Terms along with Privacy Policy Refund Policy and any written communication constitute the entire agreement between the client and Holiday Waale superseding all prior discussions representations or agreements.
Holiday Waale reserves the absolute right to refuse or cancel any booking at its discretion in cases including but not limited to
suspicious or fraudulent transactions abusive or inappropriate behavior non compliance with policies
Refunds if any in such cases shall be subject to internal review and applicable deductions.
